Hi,
I Would be grateful for any advice as we do not know where we go from here.As a defendant where can i go to get free legal advice as i cannot afford a solicitor and cannot get legal aid as i am fighting a claim for criminal injuries even though there is no evidence against me.The CPS have dropped the case because of lack of evidence.Thanks in advance. |

Hi, if you are a defendant and can not afford a solicitor then you are entitled to legal aid, every defendant is entitled to legal representation in a court of law. You say the CSP have dropped the case, that means there will be no prosecution and therefore no charge will be filed, that is the end of the case. |

Many thanks for your reply.I have been told that because the claimant is looking for criminal injury damages in the high court Legal aid has been stopped for defendants.They are also saying that they do not have to have 100% proof that the event happened like they do in a criminal investigation,only that it could have happened the way that the claimant is saying.I cant believe that he is having the nerve to try and take it further in the high court at his solicitors request when the police found absolutely no evidence and the CPS have dropped the criminal case.No one seems to want to help because there is no money at the end of it for anyone taking my side yet his solicitors are falling over themselves at the prospect of mega bucks if they win.

Hi, for a case of criminal injury damage, they have to first prove a crime has been committed. You mention mega bucks! is it a claim against you personally or a company? Although you do not need the level of proof as you would in a criminal prosecution, they still need to satisfy the judge of your guilt, you stated there is no evidence, so i find it hard to see how they can do this, you still have the chance to tell your side of what happened. No matter what the claim is, they still need proof that it actually happened, the court will not just take their word for it. Contact you local Citizens advice, they have people who specialize in this, they will prepare your case for you and represent you. |
