Hi. I'm new here so hope I keep to the rules. I will try and keep this matter short, basically 6 sets of parents signed to a contract with a Recording Company,which was more of a development company, where we paid £50 a month to have vocal coaching Microphone technique,choreography, marketing, record a single and sell the single for charity We also got 2 sponsors each of £50 totalling £600 to cover travel, clothing recording, equipment etc etc. (Yes I know what you're thinking what were they paying for)
A few monhs down the line, the Company decided to only retain three of our children the other three being deemed not good enough to carry on. However we were at the point of recording so those costs still needed to be met. The three remaining sets of parents were told that the three other parents had demended their sponsor money back totalling £300, so we were told we had to find a shortfall of £300. Eventually with only a week to go before the launch we had no choice in raising the £300 ourselves. We have now found out some things about the Company and decided not to resign a contract with them and yesterday we found out that the sponsor money was never refunded to the other three parents even though we were told it was and that we forked out. Would this come under the law as gaining money under false pretences?? Given that we would not have paid £300 between us if the Company had not lied to us, Any help much appreciated. |

Hi, some companies exploit loop holes in law, and so makes it very difficult to prove any wrong doing. On the contract there should be terms and conditions, which are normally open to interpretation so they can argue the fact until doomsday or your money runs out, whichever comes first. Not resigning the contract will give them the ammo to say you pulled out and they had every intension of refunding the other parents. I know this is hogwash, but in any dispute the company will pull out all the stops to say you are to blame and that they have done nothing wrong. A small claims court is really the way foward, but could cost you in the short term for solicitor services which you may be able to claim back if you win the case. |
