Hi all---
Got a bit of a worry. I have beautiful, established gardens to the front and rear of my rented property (housing ass'). At the side I have low level shrubs and an archway covered by a rare type of clematis.
4 years ago, (the landlord then was the council) cavity wall tie failure resulted in complete renewal of the external rendering and cosmetic finish (pebble dash alternative). A lot of damage was done to my gardens by scaffolding, rubble etc etc. The council refused to accept liability and the sub contracted firm that carried out the repairs were equally dismissive. I couldn't be bothered with arguing and waiting wasn't an option as it would have meant more problems occuring. So I made good the gardens and plants myself. It cost a fortune!
Since, the housing association have taken over as landlords.
I have found out they intend to renew the external pebble dashing on homes. Mine used to have it but due to the wall tie repair, does not now. They intend to put it back on my home!! How ridiculous.
So, I have to go through it all again.
This time, I have been told to take out all my shrubs, clematis, roses, jasmine and honeysuckle that are against and any walls. If I dont they will be taken out by the sub contractor apparently.
Problem is, the pebble dash is some 3feet from the ground due to a brick face border around my house---so why do I have to remove them???? aaaarrrrrrggggggggh!!!

So, can I reasonably refuse to have work done on the grounds it is unnecessary and already been done recently (by previous council landlord).
And, if the works cause damage to my gardens, (both the plant/shrubs that have to be removed, and surrounding areas/plants/garden) , can I demand the housing association makes good any damages or claim compensation from them?

They are being very awkward about this at the moment and I could do with knowing where I stand legally. Specific housing/tenant legislation that I could quote would be very usefull (IMG:style_emoticons/default/wink.gif)
