Hi, I am after some advise on where I stand with our joint mortgage following a split. I am happy to apply to take it on myself but I need him to sign a letter to say he is happy to do this before we can proceed. To be awkward he wont sign it but is also threatening to move out and not pay his share of the mortgage. Where do I stand legally? Many thanks, Emma

Hi EKAS,
You will need to do it properly, so that there will be no problems in the future. It will be a transfer of equity, but without his signature, it will not happen. Unfortunately, if he will not agree voluntarily, you may need to see a solicitor. Depending on the length of time he lived in the house and his contributions to the mortgage payments, bills etc, he may be entitled to some money and normally that is the reason the other half will not sign docs. |
