Is my landlord right to ask me to pay for a damaged carpet even when he has sold the property. He has cited that because of the carpet damage he has had to sell the property at a reduced value. The property was sold when the market was at the bottom.
I entered into the tenancy before the TDS came into effect. I agreed to make good of the damages, but the chap started making all sorts of unsubtantiated demands. |

Hi Jojo,
The fact that your deposit hasn’t been protected doesn’t mean you should give up. It is difficult to say as it really depends on the damage, but I find it strange that he raised the question after he has sold the property. Normally a deposit is either returned or you are informed that you will not get it back straight after you leave the property. I would imagine that this issue had been discussed at the time. Was there an inventory which stated the condition of the carpet, when you moved in? How much did you agree to pay or deduct from deposit? Did you agree in writing? |

I think the question is whether you are responsible for the damage? and whether it was raised upon completion of your tenancy? Was the house sold while you were still a tenant?
